How it is drafted

Provide informal resolution before the formal steps; a form and a named recipient; timelines at each stage; an alternative route where the grievance concerns the line manager; the right to be accompanied; the outcome in writing with reasons; and escalation.

What to look out for

An alternative route around the line manager is the whole point of the procedure — without it, the grievances that matter most are the ones that never get filed.

The Labour Relations Act 66 of 1995 does not prescribe a grievance procedure, but the absence of one is routinely held against an employer when the dispute reaches the CCMA, because it removes the employee’s internal route and makes the referral the first opportunity to be heard. Schedule 8 assumes a functioning internal process.
